BY RECEIVING THESE TERMS AND CONDITIONS, THE CLIENT AGREES TO ABIDE BY THEM

Interpretation:

In these Terms and Conditions, the following words and phrases shall bear the following meanings: “The Consultant” shall mean Sarah Rangeley or SHESSOSEASONAL. “The Client” shall mean the individual to receive the Service to be provided by the Consultant. “The Service” shall mean the Image and Style services to be provided by the Consultant to the Client. “The person booking the Service” shall mean the individual or organisation booking the Service with the Consultant regardless of whether this is the Client or not.

 

Website host:

Our products (the "Service") are hosted on Kajabi's website (the "Site"). By signing up for the Service, you understand that Kajabi will send you occasional emails related to the Service. You can unsubscribe from these emails at any time by following the instructions included in each email. However, please note that if you unsubscribe from Service-related emails, you may no longer receive important information about the Service, such as announcements of new features or changes to the Terms of Service.

 

Conditions for Booking Styling Service:

The person booking the Service will only secure a booking with the Consultant once the fees for the Service have been paid to the Consultant in full. 

 

Fees:

Outside of a radius of 30km from the Consultant’s location, reasonable travel & accommodation expenses will be payable by the Client.

 

Payment Personal Services: 

Full payment is required to secure the booking. Pay Pal or Stripe makes payment.

 

Cancellations or change of booking:

If the Client wishes to change a booking, there will be no charge up to a limit of 2 appointment changes, at which point additional charges will be invoiced. A new booking will be set according to the availability of the Client and the Consultant. For an appointment change by the Consultant, there is a policy of appointment cancellations. If there is a need for the Consultant to change the appointment due to unforeseen circumstances, another date will be offered.

No show’s, late or missed appointment:

If the Client fails to arrive at an appointment within the first 15mins of the session commencing, the booking will be cancelled to avoid impact on other Client’s booking, and the service fees will not be refunded. If the Client does not communicate why they did not arrive for their booked session, the Client will not be offered another booking.

 

Incomplete or not returned consultation form:

​If the Client fails to return the style consultation form within 48hrs of booking in the session, the session will be cancelled. The Client will be notified of the cancellation and will be allowed to reschedule once within a month from the date of cancellation notice. If the Client fails to complete the style consultation during the cancellation period, the service fees will not be refunded.

Refund:

There are no refunds issued on services once they have commenced or been completed or if less than 72 hours notice of a cancellation or reschedule is given. 

Warranty: 

The Consultant represents and warrants that it will perform the Services with reasonable skill and care.

 

Limitation of Liability: 

Subject to the Client’s obligation to pay the Fees to the Consultant, either Party’s liability arising directly out of its obligations under this Agreement and every applicable part of it shall be limited in aggregate to the Fees. The Consultant assumes no liability due to the quality of items or services purchased for or by the Client.

Intellectual Property:

Intellectual property includes, but is not limited to, the documents and/or videos that you may receive as an inclusion of your session. Dressing guidelines, shopping lists, shoppable video links, recordings of consultations on Zoom or during a face to face session or any other information shared with you during or upon completion of your session are not to be redistributed to third parties without written consent from the Consultant.

 

Confidentiality: 

Neither Party will disclose any information of the other that comes into its possession under or in relation to this Agreement and is confidential. 

 

Right of refusal:

The Consultant reserves the right to refuse anyone who wishes to book any of the services.

 

Modification:

No modification of this Agreement shall be valid unless in writing and agreed upon by both Parties. The Consultant reserve the right to modify these terms from time to time at the Consultant’s sole discretion. Therefore, you should review these pages periodically. Your continued use of these services after any such change constitutes your acceptance of the new terms. If you do not agree to these terms or any future versions of the terms, do not use (or continue to access) the services.

E-books:

E-books are digital downloads. Once you’ve purchased the E-book you will receive a confirmation email and a digital download link. To access the E-book, click the digital download link and save it to your device. You will need to open the email and save your digital download within 24 hours of your purchase as each E-book is matched with a unique download code that expires in 24 hours. No refund is available for digital products. Due to the nature of digital files the product cannot be "returned". All templates, logos, artwork, digital downloads and other items in this e-book are owned by SHESSOSEASONAL. You are not permitted to share, sell, distribute, or create derivative works from any item purchased from SHESSOSEASONAL. You may not claim these designs as your own. 

 

Subscription Service:

Members have the option of a monthly or yearly membership to SHESSOSEASONAL's Weekly Outfit Edit Plan. The checkout page details the appropriate fees. It is members responsibility to read and comprehend the precise terms and conditions that apply to any subscription fee and/or discounts or promotions. The Weekly Outfit Edit Plan fees are subject to revision and updating at any time, in SHESSOSEASONAL's sole discretion. Any such revisions or updates to the fees will be applicable prospectively to any subscriptions signed up for after the modification or update's effective date.

Members will be sent an invoice either weekly or annually (depending on your preferences) with fees shown clearly. The membership fees reflected on the invoice may show a discounted rate when a current sale or promotion is running. This does not entitle the member to any form of refund, however, they may cancel their account and sign up again at the new promotional rate. The date members sign up in is the fixed fee that will be charged even if prices increase or decrease in the future. 

Members can pay their subscription fees for the Weekly Outfit Edit membership using PayPal or a credit card through Stripe. Your subscription's cost and payment currency are both expressed in Australian dollars (AUD). You must give complete and accurate payment information when you buy a subscription. You verify that you are authorised to purchase a subscription using the payment information you provide. SHESSOSEASONAL reserves the right to immediately terminate or suspend your access to your membership if we do not receive payment authorisation or if any authorisation is subsequently canceled. If there is suspicious activity, SHESSOSEASONAL reserves the right to get in touch with the issuing bank/payment provider, police enforcement, or other suitable third parties.

If a member decides to end their subscription when there is still time left on it, they will not be entitled to any refunds. Members will be still able to access their accounts until they are formally deactivated. If a membership application is refused or rejected by us, the applicant will be entitled to a refund of any fees or payments made during the initial contact and application process. The refund will be issued promptly upon notification of the refusal or rejection. The applicant will have their membership revoked and will not gain any access to the membership. In the event that a member who was previously refused or rejected attempts to sign up for membership again after receiving a refund, they will not be entitled to any refunds for subsequent sign-ups. This policy is in place to maintain consistency and fairness among all members of The Outfit Edits Membership. 

Your subscription will automatically renew unless you cancel at least twenty-four (24) hours before the end of the current billing period. 

Members will automatically lose their subscriptions if they don't pay the monthly or annual fee on time. If you want to reactivate and continue the subscription, you must pay the subscription once more and agree to all of the terms and conditions. You will be charged the price that is listed on the subscription price plan as of the time of reactivation. You will not be qualified for any earlier pricing as a result of the cancellation of your prior membership.

Members have the option to cancel their subscription anytime by going to their profile page on the dashboard and doing so by following the instructions. The cancellation of a payment method can be done by logging into your account, going to Settings, selecting Billing Information, and then selecting the Cancel Payment Method button.Members who have their subscription canceled will still be able to access the membership for the remaining time they have paid for. If a member does not receive this email within 24 hours of canceling, they must get in touch with us right once to avoid further charges.

Members will receive an automated email every Sunday night informing them of the updated content. This weekly email's "unsubscribe" link does not remove the user from the membership. Members are also aware that while it is their responsibility to log into their accounts, if they miss this email or do not receive one, they are not entitled to any past content.

Members will be billed either monthly or yearly for recurring payments, depending on the subscription they have chosen, on the day that they originally joined up.

The product cannot be "returned" and there is no refund option due to the general nature of our digital files.

Members purchasing choices are not the responsibility of SHESSOSEASONAL.

SHESSOSEASONAL is the only owner of all templates, logos, artwork, digital downloads, and other materials included in this subscription. Nothing you get from SHESSOSEASONAL may be shared, sold, distributed, or used to make derivative works. These designs are not yours to claim as your own. These templates may not be used whole or in part to produce new works for commercial use or for sale.

When members log into their account, only the content from this week and the week prior will be available for viewing. 

Members are responsible for signing into their accounts, downloading, and saving every piece of content to their device as they won't be provided with or have access to any missed or previous content. 

After the season is done, all outfit edits will be  made available for purchase as a seasonal E-book.

By adding words or images to the community discussion, you grant SHESSOSEASONAL permission to publish them as testimonials on their social media channels. SHESSOSEASONAL reserves the right to add, remove, or modify any member's content and features at any time.

The premium membership holders are informed that the stylist only responds to the questions they can submit once each week. Members are aware that while their stylist will do her best to address their questions, no advice can be taken as a promise that it will have the intended results.SHESSOSEASONAL reserve the right to refuse access to person(s) requesting access to the membership if we are not satisfied that they intend to use the membership for its intended purpose. This is in order to create a judgement-free and safe community space for our paying members.

 

Style workshops:

 You acknowledge that:

(a) the workshop is an online course only and no physical product will be delivered to you; and

(b) workshop prices are subject to change without notice.

We do not offer refunds for workshop purchases due the the nature of our digital content the product can not be returned.

By purchasing a workshop, you are granted a non-exclusive, non-transferable licence to access and view the workshop content for your personal, non-commercial use only.

You must not:

(a) share your login details or allow anyone else to access the workshop using your account;

(b) reproduce, distribute, modify or otherwise tamper with the workshop content; or

(c) use the workshop content for any commercial purpose.

The terms and conditions of the workshop state that there is no guarantee of results, and that any results achieved are the sole responsibility of the participant. 

 

Style Audit:

Our Digital Style Audit is an online service that provides personalised style recommendations based on the photos of your current wardrobe items. To receive this service, you must send clear photos of your clothing items via email to a designated email address. Once we receive your photos, our expert stylist will analyse your current wardrobe and create a personalised style guide based on your form submission. The final style guide and recommendations will be sent to you via email in a clear and concise format.

To begin the Digital Style Audit service, you must complete a style consultation form with basic information about yourself and your style preferences. This form will be emailed to you upon payment. The form is designed to help our stylist gain a better understanding of your personal style and preferences, as well as your body type and lifestyle. Please fill out the form as accurately and comprehensively as possible to ensure the best possible recommendations. 

By completing the style consultation form, you agree to provide accurate and truthful information to the best of your knowledge. We reserve the right to reject any request for the Digital Style Audit service if the information provided is inaccurate or incomplete. We respect your privacy and will keep all information provided in the style consultation form confidential, as outlined in our confidentiality policy.

We charge a one-time fee for the Digital Style Audit service, which will be communicated to you on the checkout page. Payment must be made in full via our secure payment gateway before we begin the style audit.

After we receive your photos and completed style consultation form, our expert stylist will analyse your wardrobe and create your personalised style guide. We aim to deliver your style audit within 5-7 business days, excluding public holidays or weekends. Please note that we will send the style audit to the email address provided on the style consultation form, so please double-check that your email address is correct. We cannot be held liable for any incorrect email addresses provided. It is also your responsibility to check your spam folder or junk mail in case the style audit is filtered there. If you have not received your style audit within the estimated timeframe, please contact us and we will investigate the issue. Please be aware that the delivery time may vary depending on the volume of requests we receive and other unforeseen circumstances, but we will always strive to deliver the service in a timely and efficient manner.

We do not offer refunds on the Digital Style Audit service once payment has been made due to the file being digital and items can not be returned. However, if you are not satisfied with our service, please contact us and we will do our best to rectify the situation.

Once the style guide has been delivered, the service is deemed complete. Please note that the Digital Style Audit service is a one-time service only and does not include ongoing style advice or consultations. If you would like to receive further personalised style advice after the service has been delivered, you will need to repurchase the Digital Style Audit service again. We strongly encourage you to use the style guide as a template for creating your own wardrobe combinations and developing your personal style going forward. If you have any questions or concerns about the style guide, please do not hesitate to contact us and we will do our best to assist you.

Please note that we do not offer amendments to the Digital Style Audit service. Once you submit your photos and the style consultation form, the service is deemed to have started, and the turnaround time will begin. We recommend that you carefully review the information and photos provided before submitting to ensure that they are accurate and complete. If you have any questions or concerns about the style guide, please contact us within 7 days of receiving the style guide, and we will do our best to clarify and address any issues. However, please note that we cannot offer amendments or revisions to the style guide once it has been delivered. It is your responsibility to ensure that the information and photos provided are accurate and complete. We cannot be held liable for any inaccuracies or omissions in the style guide resulting from incomplete or inaccurate information provided by you.

We take the privacy of your personal information seriously. Any information shared during the Digital Style Audit process will be kept strictly confidential and used solely for the purpose of providing the Style Audit service.

On the style consultation form, we will ask for your consent to use the images provided for promotional purposes. If you do not wish for your images to be used for marketing, simply indicate your preference on the form or contact us at any time to withdraw your consent. We value your privacy and will always respect your preferences and choices regarding the use of your personal information.

Our stylist will provide personalised style recommendations based on the information provided and the photos of your current wardrobe. Please note that the recommendations provided are based on our stylist's best judgment and experience, and are not guaranteed to work for everyone. While we make every effort to provide accurate and helpful advice, please understand that our stylist is not with you in person to assess your individual needs, measurements, and body type. The style guide and recommendations are simply a template for you to use on your own. We cannot guarantee the accuracy or effectiveness of our recommendations. We strongly encourage you to use your own judgment and discretion when following the recommendations provided in the style guide. You are responsible for any decisions you make based on the style guide and recommendations provided.

We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. You should regularly check this page for any changes. Your continued use of the Service after any such changes constitutes your acceptance of the new terms and conditions.

We reserve the right to reject any request for the Digital Style Audit service at our sole discretion. If we reject your request, we will notify you via email and provide a full refund.

If we are unable to provide you with the Digital Style Audit service due to unforeseen circumstances, such as technical issues or force major events, we will notify you as soon as possible and provide a full refund.

Based on the style audit, our stylist may provide you with a shopping list of recommended items to enhance and complement your existing wardrobe. Please note that the shopping list is just a guide and it is up to you to decide if you wish to shop for the recommended items. We cannot guarantee the availability or suitability of any specific items on the shopping list, and we cannot be held liable for any loss or damage that may result from your purchase of these items. You are responsible for any decisions you make based on the shopping list and recommendations provided.

General:

If any provision of these terms and conditions is found to be invalid or unenforceable by a court of law, that provision will be severed from these terms and conditions and the remaining provisions will continue to apply.

These terms and conditions are governed by the laws of Queensland, Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State.
